Did John McCain borrow T. Boone Pickens' commercial?

In his speech today, McCain said "we are sending 700 billion dollars a year to foreign countries to pay for oil". This line has been lifted from Texas oilman T. Boone Pickens' commercial about wind energy. Is it legal to copy a commercial? It clearly shows McCain has nothing original, everything he says is borrowed.
